I hate it, but I agree with the Conservative Action Project on the health insurance bill

"Mandating that individuals must obtain health insurance, and imposing any penalty – civil or criminal – on any private citizen for not purchasing health insurance is not authorized by any provision of the U.S. Constitution."

I think the public option might have kept the mandate from being unconstitutional, which is probably why it was fought so hard.

Name another instance where the federal government forces individiduals, under pain of fine or imprisonment, to purchase any other good or service from a private, for-profit provider. I can't think of any.

Comments:
Whether it is constitutional or not is up to the courts. Yet, I have to agree - without the public option, this is a practically unenforceable clause. In all honesty, legally forcing people who cannot afford to do so to purchase health insurance, then jailing and/or fining them if they do not do so is among the more stupid ideas I can imagine. The whole point of health care reform was to provide health coverage to those who cannot afford it. All this provision, absent a public option, does is punish the very people the entire thing is supposed to help.

Our politicians is stupid, no?

Auto insurance?

That's state government, not federal, but more importantly, it is required only of those who have obtained the privilege of a driver's license. No license, no insurance required.

Let me see, is this a new question?
Henry David Thoreau ask this about the Mexican American War tax didn't he?
Oh that was a "tax".

So I have been forced by the Federal Government to pay Halliburton via my taxes for the last 8 years or so. Not the same?
Really? You mean this mandate is not a tax? It does kinda look like a "sur-tax".

OK, where does the Draft, Federal jury duty, and Social Security registration all imposed (or imposable) on all U.S. citizens get authorized in the Constitution?
Remember about 4 years when GWB was going to require U.S. citizens to buy private stocks-bonds-etc in lieu of SS payments in they didn't want to pay SS?

Any way the Fat Lady ain't sung yet.
Let's see what happens.

Hate to stray off topic, but Merry Christmas to all. May we honor he who came preaching good news to the poor, liberty for the captive, health for the ill and the day of God's good favor in a suitably joyful way.

Peace.

And unto you!

Auto insurance? When they come up with that? Next you'a be tellin me I gots to have front-lights and a muffler! Damn caesar with its new fangled rules!

Question: If queen Mary(La.) and that feller from Nebraska can hold out voting 'yea' until they gets more money to pay fer stuff...I's gonna hold out gettin it til they gives me something...a camo snuggie and one of them big turkey frying pots...oooo! and one of them skinny TV's what can be stuck on the wall!

Question 2: Is crocky-pot-explodin-seered-up tear ducts a pre-existencing condition?
